1. Seller Policy

1.1 Registration & Listing Fees

• The Seller shall pay a non-refundable registration and listing fee of AED 300 upon submitting a horse for auction.
• In the event the horse is withdrawn by the Seller for any reason whatsoever, the listing fee shall not be refunded.

1.2 Mandatory Documentation & Media

The Seller must provide the following:

• A clear video of the horse at trot speed, without a saddle, showing the horse moving away from and toward the camera.
• Recent photographs of the horse from all angles (left, right, front, and rear).
• Clear photographs of all legs, front and rear, clearly displaying tendons and the fetlock.
• If the horse is broken or ridden: a video of a rider mounted on the horse at trot and canter.
• If the horse is intended for jumping: a recent video of the horse jumping.
• A photograph of the horse’s microchip (if available).
• A valid and comprehensive lameness examination report issued by:
  • Sharjah Equine Hospital, or
  • Dubai Equine Hospital, or
  • Any veterinary hospital approved by Kajoor Stables.

1.3 Accuracy of Information

• The Seller warrants that all information provided is true, complete, and accurate.
• Any misrepresentation or omission shall be the sole responsibility of the Seller.
• Kajoor Stables shall bear no liability for disputes arising from discrepancies between the horse’s description and its actual condition.

1.4 Commission

• Upon the successful sale of a horse, Kajoor Stables shall be entitled to a commission of AED 1,200, inclusive of the listing fee.
• The commission shall be deducted directly from the sale proceeds.

1.5 Pre-Auction Inspection

• Bidders may inspect the horse prior to the auction.
• Inspection shall be ground examination only, without excessive pressure or any action that may risk injury.
• Kajoor Stables shall arrange the inspection time and location.
• The inspection shall be conducted under the supervision of the Seller and Kajoor Stables.
• Kajoor Stables shall bear no responsibility for inspection results or interpretations.

1.6 Boarding After Sale

• The sold horse shall be granted three (3) complimentary boarding days starting from the auction closing date.
• Thereafter:
  
  • In case the Buyer delays collection:
    • The Buyer shall be charged boarding fee.
    • If the horse is not collected within fourteen (14) days, Kajoor Stables reserves the right to dispose of the horse at its sole discretion without any liability.

    • In the event the buyer is located outside the United Arab Emirates, they shall bear all costs and procedures related to transporting the horse to the destination country.

2. Buyer (Bidder) Policy

2.1 Participation Deposit

• Bidders must pay a refundable participation deposit of AED 2,000.
• The deposit is refundable only if the bidder does not win the auction.
• Kajoor Stables reserves the right to confiscate the deposit in the event of any breach of terms.

2.2 Minimum Bid Increment

• The minimum bid increase shall be AED 200.
• All bids are final and irrevocable.

2.3 Payment Upon Winning

• The winning bidder must pay the full purchase price to Kajoor Stables within forty-eight (48) hours from auction conclusion.
• Failure to pay shall entitle Kajoor Stables to:
  • Confiscate the AED 2,000 deposit, and
  • Re-list the horse for auction without any liability.

3. General Terms & Legal Protection

3.1 Role of Kajoor Stables

• Kajoor Stables operates solely as an auction facilitator and platform administrator.
• Kajoor Stables is not a seller nor a partner in the sale and provides no express or implied warranties.

3.2 Sale Condition

• All horses are sold “As Is, Where Is.”
• Participation in bidding constitutes full acceptance of the horse’s existing condition.

3.3 Disputes

• Any dispute arising between the Seller and Buyer shall be resolved solely between them.
• Kajoor Stables shall be fully indemnified against all claims, losses, or damages.

3.4 Auction Suspension or Cancellation

• Kajoor Stables reserves the right to cancel, postpone, or suspend any auction at its discretion for technical, legal, safety, or integrity reasons.

3.5 Prohibited Conduct

• Bid manipulation, sham bidding, or any malicious activity is strictly prohibited.
• Kajoor Stables may suspend accounts, cancel bids, and confiscate deposits where misconduct is suspected.

3.6 Force Majeure

• Kajoor Stables shall not be liable for any failure or delay due to force majeure, technical failures, or governmental actions.

3.7 Death of Horse – Liability Disclaimer

• In the event of the death of a horse during the auction period or while boarding at Kajoor Stables for any reason whatsoever, whether natural, medical, accidental, or otherwise, Kajoor Stables shall bear no legal, financial, or compensatory liability toward the Seller, Buyer, or any third party.
• Responsibility for insurance coverage, if any, rests solely with the horse owner.
• Participation in the auction constitutes explicit acceptance of this clause.

3.8 Governing Law & Jurisdiction

• These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates.
• The courts of the UAE shall have exclusive jurisdiction.
